The problem:

The California Lemon Law provides very important protections to consumers who have purchased or leased vehicles. If a vehicle is purchased or leased with a warranty, the seller and manufacturer of the vehicle have a duty to honor the warranty. If the vehicle has broken down an unreasonable amount of times, and if the manufacturer has been unable to repair the vehicle after a reasonable number of repair attempts, the purchaser of the vehicle may be able to force the seller and manufacturer to repurchase the vehicle, and refund most of the money paid.

California Civil Code Section 1793.2 states that, with very few exceptions, if a consumer presents a vehicle to an authorized dealership for repairs, and if the dealership does not repair the vehicle after a reasonable number of attempts, the manufacturer shall either replace the goods or reimburse the consumer in an amount equal to the purchase price paid by the consumer, less that amount directly attributable to use by the consumer prior to the discovery of the nonconformity.

California Civil Code Section 1793.22 states that if within the first 18 months, or 18,000 miles of service, a vehicle is presented to an authorized dealership four or more times for a problem which substantially effects the vehicle’s use, value, or safety, then there is a presumption that the vehicle should be repurchased. If the problem is one which is likely to result in death or serious bodily injury, only two repair attempts are needed within that time frame to create the presumption. Furthermore, if the vehicle is out of service for repairs for more than 30 days within the first 18 months, or 18,000 of service, then there shall be a presumption that the vehicle should be repurchased.
